At present there is theoretical and practical interest in a question about the introduction of posts in the criminal-executive system (further - UIS). In the legislation it is fixed, that the posts of civil service are established by Federal law or another normative legal report of the Russian Federation, by law or another normative legal report of the subject of the Russian Federation. The founded posts of civil service, are subject to the start in the list of the posts of civil service, after which they acquire legitimate nature. A quantity of posts in UIS is found in the dependence on the fund of the payment of labor and monetary allowance of the soldiers and persons equated to them, who are established by federal law about the Federal Budget for the appropriate financial year for each federal organ of power of the state. By law-subjected normative legal reports are affirmed the enumerations of the posts of those replaced by the persons of series, youngest, average, elder and highest of that commanding in UIS, and corresponding to these posts special titles. The analysis legal of the reports pointed out above makes it possible to draw the conclusion that in UIS are introduced the posts of the following three forms: federal state civil service; being subject to substitution by the persons of the series and commanding composition and those being containing due to the means of Federal Budget; the post of workers and employees, not being been the posts of civil service (for example, the manager by the camera of storage, manager by economy (club)). The working activity of workers, who replace these posts, is regulated by the legislation of the Russian Federation about the labor.
